  1. Purpose, legal basis and duration of data processing personal data

We will process your Personal Data to:

  • assess your qualifications for the position you are applying for;
  • assess your abilities and skills for the position you are applying for;
  • if you apply to our talent bank, assess your qualifications, abilities and skills needed to work with us;
  • if you have consented to the processing of your Personal Data for the purposes of future recruitments, assess your qualifications, abilities and skills needed to work with us in future recruitments;
  • Choose the right person to work with us.

Legal basis to process your Personal Data is:

  • Provision of law (art. 221 § 1 of the Labour Code) i przetwarzanie potrzebne do zawarcia umowy o pracę.
  • Your consent to the processing of Personal Data provided in your CV and cover letter (Article 221a and Article 221b of the Labour Code), if you provide us with data other than those indicated in Article 221 § 1 of the Labour Code. This consent is given voluntarily, by showing your will to consent to us the processing of your Personal Data and takes the form of an explicit affirmative action in the form of sending or directly providing us with the above data as part of the recruitment process. This consent also applies to your public image when it is included in your CV and cover letter.
  • Your consent to the processing of all Personal Data provided in your CV and cover letter (Article 221a and Article 221b of the Labour Code), if you provide us with this data as part of your application to our talent bank. This consent is given voluntarily, by showing your will to consent to us processing your Personal Data and takes the form of an explicit affirmative action in the form of sending or directly transmitting the above data to us as part of your application to our talent bank.
  • Your consent to the processing of all Personal Data provided in your CV and cover letter (Art. 221a and Art. 221b of the Labour Code), if you provide us with this data for the purposes of future recruitment. This consent is given voluntarily, by way of a written statement or by e-mail.
  • Our legitimate interest – in terms of data collected during the interview and the results of the placement tests. We have a legitimate interest in checking your skills and abilities – we need this to assess whether you are the right person for the role we are recruiting for.
  1. Use of recruitment tasks

As part of the recruitment process, we can carry out recruitment tasks related to knowledge of specific topics and verification of skills. Such tasks are designed to see if you have the skills needed to work in the position you are applying for

  1. Period of storage of Personal Data

We will store your Personal Data until the recruitment process for the position for which you apply is completed or until you withdraw your consent.

In the case of recruitment for a talent bank or consent to the processing your Personal Data for the purposes of future recruitment, we will store your personal data for a period of 3 years or until you withdraw your consent.

  1. Personal Data recipients

We will transfer your Personal Data to:

  • our suppliers to whom we commission services related to the processing of Personal Data, e.g. IT service providers. Such entities process data on the basis of a contract with us and only in accordance with our instructions.
  • entities within our capital group when you apply to our talent bank to assess your qualifications, abilities and skills needed to work in each of our units.
  1. Transfer of Personal Data to third countries or international organizations

We do not transfer your data outside the European Economic Area, however, the person processing your Personal Data on our behalf may entrust it to further processors outside the European Economic Area.

Transfer of Personal Data outside the European Economic Area are subject to one of the following conditions: (I) the processing is carried out by an entity for which an adequacy decision has been issued, (II) the processing is carried out by an entity that participates in the Privacy Shield Program, (III) the processing is carried out by the entity under binding corporate rules.

  1. Your rights related to the processing of Personal Data and automated decision-making

You have the following rights related to the processing of your Personal Data:

a. the right to withdraw your consent to the processing of your Personal Data – you have the right to withdraw your consent to the processing of your Personal Data at any time,

b. the right to access your Personal Data and receive a subsequent copy of Personal Data,

c. the right to request rectification (correction) of your Personal Data,

d. the right to request the deletion of your Personal Data – if your task is not justified for us to process your data, you can request that we delete it,

e. the right to request the restriction of the processing of your Personal Data – you can request that we limit the processing of your Personal Data only to their storage or performance of activities agreed with you, if in your opinion we have incorrect data about you or we process them unjustifiably; or you do not want us to delete it because you need it to establish, exercise or defend legal claims; or for the duration of your objection to the processing of your data,

f. the right to object to the processing of your Personal Data due to your particular situation, which in your opinion justifies the cessation of the processing covered by the objection – in cases where we process your data on the basis of our legitimate interest. We will stop processing your Personal Data for this purpose, unless we can demonstrate that the grounds for our processing of your data override your rights or that your data is necessary for us to establish, exercise or defend legal claims.

g. the right to data portability of your personal data, i.e. the right to receive your personal data from us in a structured, commonly used and machine-readable format. You can transfer this data to another data controller or request that we transfer your data to another controller. However, we will only do so if it is technically possible to do so. You only have the right to data portability with respect to data that we process on the basis of a contract with you or on the basis of your consent.

Right to withdraw consent

To the extent that your Personal Data is processed on the basis of consent – you have the right to withdraw your consent to data processing at any time. Withdrawal of consent does not affect the lawfulness of processing based on your consent before its withdrawal. You can withdraw your consent by sending a statement of withdrawal of consent to our correspondence address or to our e-mail address – contact details in point 1 above.

The right to file a complaint           

You also have the right to file a complaint with the supervisory authority dealing with the protection of personal data, i.e.The President of the Office for Personal Data Protection.

  1. Information about the requirement/voluntariness of providing data

Providing your data:

  • Is necessary to take part in the recruitment process and to conclude an employment contract with respect to the data indicated in Article 221 of the Labour Code.
  • Is voluntary with respect to the data provided in your CV and cover letter, if you provide us with data other than those indicated in Article 221 § 1 of the Labour Code.
  • Is voluntary to submit a CV and cover letter to our talent bank or for future recruitments.

If you do not provide your data, you will not be able to be included in our recruitment processes (current or future) or in our talent bank.
